EVM Controls Consulting LLC (“EVMCS,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect personal information associated with our website, inquiries, consulting services, training, software purchases, licensing, and support.
This policy covers information handled by EVMCS. Third-party websites and platforms may have their own privacy policies. Any separate product-specific privacy notice will identify additional practices applicable to that product.
1. Information We Collect
Depending on how you interact with us, we may collect:
-
Contact information: Your name, email address, telephone number, company, job title, and mailing or billing address.
-
Purchase information: Products or services purchased, transaction identifiers, payment status, and billing records.
-
Account and registration information: Information provided when registering for courses, webinars, services, or supported product accounts.
-
Software licensing information: Your designated user email address, company, Machine ID or similar device identifier, license key, activation information, and license status.
-
Communications and support information: Messages, inquiries, survey responses, and files or screenshots you voluntarily provide.
-
Website usage information: IP address, browser and device information, referring pages, pages visited, and interactions collected through website logs, cookies, or similar technologies.
Please do not send passwords, payment-card details, or sensitive personal information through ordinary email or support attachments.
2. When We Collect Information
We collect information when you contact us, submit a form, request a proposal, purchase a product or service, register for training or a webinar, subscribe to communications, activate a software license, or request support.
Our website and its service providers may also collect certain technical information automatically when you visit.
3. How We Use Information
We use information as reasonably necessary to:
-
Respond to inquiries and provide requested services.
-
Process purchases and maintain transaction records.
-
Issue, validate, replace, and administer software licenses.
-
Deliver training, webinars, downloads, and customer support.
-
Send purchase confirmations, license notices, service updates, and other administrative communications.
-
Send marketing communications, subject to applicable consent requirements and your communication preferences.
-
Understand website usage and improve our offerings.
-
Protect our systems, prevent fraud, resolve disputes, and comply with legal obligations.
4. Payment Processing
Payments are handled through third-party payment processors, such as Stripe or the processor identified at checkout.
Payment-card information submitted through a processor’s payment interface is handled under that processor’s privacy and security practices. We may receive transaction details, payment status, billing information, and limited payment-method information needed to administer your purchase.
Do not send full payment-card numbers or security codes directly to EVMCS.
5. Desktop Software and Project Information
XER EVM Code Organizer Pro processes project and schedule information locally in Microsoft Excel. Its standard operation does not automatically upload your project files or generated Output to EVMCS.
Licensing information is handled separately from project information. License and trial records may be stored locally, including in the Windows registry, and information needed to administer a license may be provided to EVMCS.
This local-processing description applies specifically to XER EVM Code Organizer Pro. It does not describe the operation of a cloud-hosted product or a third-party service you choose to use.
6. Files Submitted for Support
You may voluntarily send project files, XER files, workbooks, screenshots, or other materials when requesting assistance.
Only submit information you are authorized to share. Remove confidential or personal information that is unnecessary for troubleshooting.
We use support submissions to investigate and resolve your request and perform related troubleshooting. We restrict access to personnel and service providers who need the information for those purposes and are subject to appropriate confidentiality obligations.
We do not use identifiable customer project content for public demonstrations, marketing, or training artificial intelligence models without separate permission.
7. Cookies and Similar Technologies
Our website is hosted on Wix.
-
Wix and its service providers place cookies and similar technologies that are needed to operate the website, such as keeping the site secure, maintaining sessions, and remembering your cookie choices. These essential cookies cannot be switched off without affecting how the website works.
-
We also use Wix's built-in website statistics to understand how visitors use the site in aggregate, such as pages viewed and how visitors arrive.
-
We use this information only to maintain and improve our website.
-
We do not use advertising cookies, retargeting tools, or advertising tracking pixels. You can block or delete cookies through your browser settings and, where shown, through the cookie banner on our website. Blocking essential cookies may prevent parts of the website from working.
-
Our website does not currently respond to browser "Do Not Track" signals; where applicable law recognizes a global opt-out signal, we will honor it as required.
For more information about the cookies Wix uses, see Wix's cookie information at https://support.wix.com.
8. How We Share Information
We may disclose relevant information to:
-
Service providers supporting website hosting, payment processing, course or webinar delivery, email communications, licensing, technical support, and business administration.
-
Professional advisers, including attorneys, accountants, and insurers, where reasonably necessary.
-
Authorities or other parties where disclosure is required by law or reasonably necessary to address fraud, security incidents, legal claims, or threats to rights or safety.
-
A successor business in connection with a merger, acquisition, reorganization, or transfer of relevant business assets, subject to applicable protections.
-
Other recipients you authorize or direct us to use.
We limit disclosures to information appropriate for the relevant purpose. We do not sell personal information, and we do not share personal information for cross-context behavioral or targeted advertising. Our service providers may use information only to provide services to us.
9. Information Security
We use reasonable administrative, technical, and organizational safeguards appropriate to the information we handle.
No website, transmission method, or storage system is completely secure. We cannot guarantee absolute security.
If a security incident requires notification, we will notify affected individuals and authorities as required by applicable law.
10. Information Retention
We retain personal information for as long as reasonably necessary to provide services, administer licenses, maintain business and transaction records, resolve disputes, and meet legal obligations.
Support files are retained while reasonably needed for troubleshooting and related follow-up, then deleted or deidentified when no longer needed, subject to legal retention requirements and ordinary backup cycles.
Backup copies may remain until overwritten or deleted through the applicable backup process.
11. Your Choices and Privacy Requests
You may contact info@evmcs.com to request access to, correction of, or deletion of personal information we hold about you.
Depending on your location and applicable law, you may also have rights to obtain a portable copy of information or opt out of certain processing, including targeted advertising or sale of personal information where applicable.
We may need to verify your identity and authority before acting on a request. Certain information may be retained where permitted or required by law.
If we decline a request, you may ask us to reconsider by emailing info@evmcs.com with the subject “Privacy Request Appeal.” We will handle requests and appeals within applicable legal deadlines and provide any required explanation or complaint information.
We will not unlawfully discriminate against you for exercising applicable privacy rights.
12. Email Preferences
You may unsubscribe from marketing emails using the unsubscribe link in the message or by contacting info@evmcs.com.
Unsubscribing from marketing does not stop necessary communications about purchases, software licenses, support requests, security, or other services you have requested.
13. Third-Party Websites and Platforms
Our website and communications may link to third-party websites, payment services, learning platforms, webinar services, or other tools.
Those services may collect information under their own privacy policies. Review their policies before providing information. This policy does not describe practices independently controlled by those third parties.
